ITANAGAR, May 31: The Human Rights Law Network (HRLN) Arunachal Pradesh unit has expressed concern over the illegal detention of a minor girl under the Arunachal Pradesh Prevention of Unlawful Activities (Prevention) Act 2014, in connection with the recent 72-hour bandh call.
In a letter addressed to the District Magistrate, Capital and to the Superintendent of Police, Special Investigation Team, the HRLN questioned why established protocols were not followed in this case and said "It is alarming to note that such a grave error was made, leading to the unjustifiable detention of a minor for a period of 16 days. This raises serious concerns about the due process followed by the authorities involved."
The signatories in the letter Advocate Ebo Mili and Advocate Tado Siga said "The minor's illegal detention for such a prolonged period raises questions about the competency and knowledge of the personnel responsible for the arrest and subsequent handling of the case. According to the Juvenile Justice (JJ) Act, it is imperative that a minor be immediately produced before the Juvenile Justice Board (JJB) upon discovery of their age. However, it appears that the necessary procedures were not followed, as the minor was not promptly presented before the JJB but instead sent to the Juvenile Home Pasighat."
This alarming oversight indicates a lack of understanding and awareness among the authorities regarding the correct procedures for handling minors in such cases. It is crucial to ensure that those in positions of power are well-versed in the legal and procedural aspects concerning minors to prevent such errors from occurring in the future, the Human Rights Law Network further stated.
It further sought a clarification regarding the circumstances that led to the illegal detention of the minor and appropriate action against those responsible for the oversight.
