Eye-wash on CBI’s enquiry report

ITANAGAR, Apr 16:  When the BJP government was formed in Arunachal Pradesh in July 2016, there was much expectation among the people. Expectation was high that the new dispensation will stop corrupt practices, cleanse the system, investigate charges and punish culprits. However, over these past years, the mirage appears to be disappearing as per the documents accessed by this daily.
Under the direction and supervision of the Supreme Court of India, the Central Bureau of Investigation (CBI) sent a preliminary enquiry report to the Chief Secretary, Govt of Arunachal Pradesh (GoAP) vide No 6453/PE/BDI/CBI/BSE&FC/0005 dated 01-08-2016 and stated irregularities, systemic failure and criminal conspiracy of vested individuals and officials with regards to mining and marketing of coal from Namchik-Namphuk Coal Fields (NNCF).
“Utter disregard to contents of the “Work Order” vide No MDTC/NN-CB/OT/2006 dated March 7, 2007 has been clearly spelt out in the CBI’s preliminary enquiry report,” said litigant in the PIL case No: PIL/13/2019, Kaku Potom while adding, the payment against sale of coal was to be made by way of Account Payee demand draft drawn in favour of Managing Director, AP Mineral Development & Trading Corporation Limited (APMDTCL).
“Extracting and marketing contractor of NNCF, M/s National Mining Corporation Limited (NMCL) has received huge amout over several transactions in its bank account, instead of M/s APMDTCL receiving the payment,” informed Potom while questioning the wisdom of the government in allowing such violation of the “Work Order” as much as GoAP’s lack of will to initiate any legal action to investigate the wrongdoings on part of officials and contractors or even to recover the losses.

GoAP’s sham committee

ITANAGAR, Apr 16: In what could be termed as mockery of the CBI’s report, GoAP constituted a six-member committee comprising of five officials from the Geology and Mining department itself and one more from Directorate of Industries vide order no MDTC/CBI/201/2013 (Vol-II) dated 12th January 2017.
As incredulous as it may sound, all the officials who were “Show-Caused” in this very case, were made members of the committee to look into the findings of the CBI. Also, these officials are immediate reportees of the Director, Geology & Mining, GoAP except one.
“How could officials allegedly “accused” of wrongdoings be tasked to enquire into the same case?” questioned Potom adding, how could junior staff enquire into CBI's findings. Sham committee constituted to look into the findings of the CBI itself speaks volumes about the intent and integrity of the top-honchos in the government, said Kaku Potom while adding, CBI enquiry was done under the direction and supervision of the Supreme Court of India in the case Manohar Lal Sharma Vs The Principal Secretary & Ors of the Writ petition (CRL.) no. 120 of 2012.
“Despite the gravity of the case and its contents, response of the GoAP to the SC monitored CBI enquiry and its findings is not only appalling but shows utter disregard for the law of the land. The committee should have comprised of independent members,’ said Potom.
