KHONSA, Apr 16: Special Court, POCSO, Khonsa today convicted a mother u/s 22(1) of the POCSO Act for making a complaint which after investigation proved to be false.
The case dates back to April 15, 2018 when a written FIR was submitted by the parents alleging that one W Wangham has raped their minor daughter aged about 11 years then. On receipt of the FIR (Longding PS Case No.24/18) a case u/s 376/506 of the IPC r/w Section 6 of the POCSO Act was registered and an investigation was launched. This led to Wangham’s arrest and a subsequent judicial custody spanning over 8 months and 19 days. However, as the investigation took its course, it was found by the IO that the allegation is baseless, which he also noted in the Final Report. The Special Court took cognizance against the parents under Section 22(1) of POCSO Act and took them in custody. Today, after completion of the trial it was revealed that the mother of the child used to trade illegal drugs (Kani) for which another case is pending against her. Wangham used to visit her during odd hours and there were also rumours that to save herself, she brought the false allegation with the sole intention of maligning him. The father who was away from home, unfortunately, acted as per the false information provided by his wife and lodged the FIR.
Special Judge H. Kashyap took cognizance of the offence on February 22 last and expeditiously completed the trial. The mother has been convicted under Sec. 22(1) of POCSO Act and awarded a rigorous imprisonment for six months along with a fine. However, the father was found innocent and acquitted by the court.
Section 22(1) of the POCSO Act provides that any person making false complaint or providing false information against any person, in respect of an offence committed u/s 3,5,7 and 9 solely with the intention to humiliate, extort or defame him shall be punishable with an imprisonment for a term which may extend to six months or a fine or with both.
