Itanagar, Mar 4: The Itanagar Capital administration carried out eviction of the temporary vending area at the bustling Ganga area of the capital today under the direction and supervision of DC cum DM Capital Cum Administrator Highway.
Under the provisions of Arunachal Pradesh Street Vendor( Protection of Livelihood and Regulations of Street Vending) Act, 2011, the then DC Prince Dhawan, had notified Temporary vending area for vendors at two locations-- near the Clock Tower and area opposite Bank of Baroda on 23rd August 2017 which were purely on temporary basis.
On 27 May 2021, the incumbent DC had issued an order for De-notification cum cancellation of the two notified temporary vending zones on the ground that the vending zones falls under the strip plan of NH-415, 4- lane highway as the same has already been earmarked as Bus Bay by the highway authorities.
However, the representatives of street vendors approached the High Court for quashing of the said order of eviction based on the earlier order issued in 2017.
The High Court vide its ruling dated February 16 this year had highlighted that both the orders issued by Deputy Commissioner Capital dated 23rd August, 2017 and 27th May, 2021 were issued beyond the provisions of Arunachal Pradesh Street Vendor (Protection of Livelihood and Regulations of Street Vending) Act.
Hence, the incumbent DC on the basis of the notice served earlier on 4th August 2021 carried out the eviction in his capacity as Highway Administrator under the provisions of the Control of National Highways (Land and Traffic) Act, 2002.
