KHONSA, Mar 30: In yet another instance of delivering an appropriate justice to the victim that came within less than a week, Special Court, POCSO, Khonsa today sentenced a man to life imprisonment for committing aggravated sexual assault on his step-daughter along with a fine u/s 6 of the POCSO Act.
According to the case details, the convicted person aged around 42, a native of Singrap village in Namsai district was married to a Nepali woman and fathered four male children. However, after separation he re-married a woman who already had two girl children from her previous marriage and all of them resided under one roof at Kharsang in Changlang district. From the investigation it was revealed that on the day of the incident, the victim girl aged around 10 years was playing with her younger brother at the residence of their neighbour. The father came home drunk and upon finding his daughter absent brought her back from the neighbour’s residence and then took her in the jungle and committed the heinous act. Meanwhile, as the victim did not return home her mother went in for a search and discovered her crying in pain. The child then disclosed the incident to her mother and later after arrival at home and asked about the details, the father fled away from the spot instantly.
The bleeding child was immediately taken to CHC Kharsang, where Dr G. Majee examined her and referred for informing the police. Accordingly the victim’s mother immediately lodged an FIR at Kharsang Police Station. Inspector Krishna Mohan Das took over the charge of investigation and submitted the charge sheet. Special Public Prosecutor Nyajin Hallang conducted the prosecution and the victim girl, her mother, brother and neighbours testified as prosecution witnesses. On completion of the trial it was found that the miscreant father has committed an aggravated penetrative sexual assault on his step daughter which is a punishable offence u/s 6 of the POCSO Act.
Special Judge (POCSO) H. Kashyap expeditiously completed the trial within two months of submission of charge by the police and sentenced the accused to life imprisonment which means the rest of his life will be behind the bars along with an imposition of a fine.
Delivering the judgment, the Special Judge observed that the offence committed by the convict is a stain on humanity and human civilization which deserves no mercy. The court has referred the case to the District Legal Services Authority, Changlang for adequate compensation to the victim for her rehabilitation under Arunachal Pradesh Victim Compensation Scheme, 2011.
