KHONSA, Mar 25: Special Court, POCSO, Khonsa today convicted two miscreants u/s 10 of the POCSO Act for committing aggravated sexual assault on a girl child aged around 13 years and sentenced them to 5-year rigorous imprisonment along with fine.
Sunil Soy (33) and Binod Kaur @Bura (25), the two miscreants committed the crime allegedly when the victim girl with her younger sister went out for grazing their goats in a nearby jungle. The convicts lured the victim by giving chocolate and after taking her inside their camp, committed the sexual offence. The younger sister while searching for the victim came across the camp and after peeping through the bamboo wall saw the entire incident. During the course of investigation it was revealed that the miscreants gave Rs. 120 to the victim and threatened her with dire consequences if she disclosed the incident to anyone. However, both the siblings narrated the incident to their parents and their father then lodged an FIR at the Jairampur Police Station.
ASI L. Pansa and SI Umeshan C of Jairampur PS conducted the investigation followed by submission of charge sheet against the accused duo. Special Public Prosecutor Nyajin Hallang conducted the prosecution wherein the victim, her sister who was an eyewitness to the crime and their parents testified as prosecution witnesses. On completion of the trial it was found that even though the sexual assault was not to the extent which can be called rape, the accused persons, however, have committed the offence of ‘gang sexual assault’. Special Judge  H. Kashyap after expeditiously completing the trial awarded the punishment leading to justice for the victim.
The court has also referred the matter to District Legal Services Authority, Changlang for providing adequate compensation to the victim for her rehabilitation under Arunachal Pradesh Victim Compensation Scheme, 2011. DIPRO
