BASAR, May 12: POCSO Court, Basar has sentenced a man to 20 years rigorous imprisonment along with a cumulative fine of Rs.4,000 for forcefully kidnapping a 6-year old girl child and raping her.
The judgement made u/s 376(3) of the IPC r/w Section 6 of POCSO Act, 2012 was delivered by Special Judge POCSO Court, Basar Tage Halley on May 6 last. The convict Bombe alias Bombay Riba (25) additionally has been convicted and sentenced to undergo three years of imprisonment u/s 363 of the IPC which will run concurrently. Meanwhile, all the fine amounts arising out of the above charging sections imposed against the convict have been deposited to the court which shall be paid to the minor victim through her parents/guardian at the earliest. Furthermore, as per submission made by Special Public Prosecutor K. Angu, the application for compensation submitted under Arunachal Pradesh Victim Compensation Scheme, 2011 through the District Legal Services Authority, West Siang has been approved by the Arunachal Pradesh State Legal Services Authority (APSLSA) that will be utilised for the victim’s rehabilitation. The case dates back to April 30, 2020 when the victim’s father lodged a written FIR alleging that at around 1600 hrs on the same day his 6-year old daughter was forcefully kidnapped from his home by Bombe and after taking the victim to the nearby river, he raped her. On receipt of the FIR, the OC, PS Basar registered a case vide Basar PS Case No.08/20 u/s 363/376 IPC r/w Section 4 of POCSO Act, 2012 and launched an investigation. During investigation, it was found that the accused and the victim were neighbours of the same village and knew each other well. After completing the investigation, the Investigating Officer (IO) filed the charge sheet on May 5, 2020 and the case was directly forwarded to Special Court (POSCO), Basar by the Superintendent of Police, West Siang on March 15, 2021 for trial.

In the course of trial a formal charge was framed against the accused vide order dated May 5, 2021. The accused while pleading guilty admitted that he was drunk on the day of incident and had committed the heinous crime. DIPRO
