Association criticises eviction decree

ITANAGAR, Oct 24: The Itanagar Commercial Building Affected Owner’s Welfare Association (ICBAOWA) on Wednesday demanded that before pulling down their structures along the RoW for the ongoing four-laning of NH415, the state government must pay adequate compensation as per Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
Interacting with presspersons, legal advisor, ICBAOWA,  Advocate, Likha Tabin criticized the district administration for allegedly issuing an eviction notice when DPR of the said project had already been prepared, tender passed and work handed over to executing agencies and progressing at full pace.
Also referring to High court judgment passed recently over the lands in question, Tabin said that the court while acknowledging the plight of commercial building owners has stayed the eviction order from Chandranagar to Papu Nallah proposed to be carried out with effect from October 23  and directed the concerned authority to maintain status quo till the  matter is resolved.
The ICBAOWA while challenging the eviction order issued by Extra Assistant Commissioner, Itanagar had approached the Itanagar Bench of Gauhati High Court on October 16 with a PIL seeking a stay order pleading the HC to direct the  state government to  pay owners of the affected buildings adequate compensation before demolishing their structures falling within 30 metres along the RoW.
Claiming that all the affected owners possessed genuine land allotment certificates also, Tabin said according to Right to Fair Compensation and Transparency in Land Acquisition the government is obliged to  provide compensation to cover losses incurred by landowners from surrendering their land for public purpose.
“ If district administration proceeds with the eviction drive then it will go against the court order and we will not allow the destruction to continue before affected landowners are compensated for the losses,” he affirmed.
He also said that the owners are ready to give their lands as it is for development purpose but before that, the state government must pay  compensation for the structures raised with their hard earned money.
Justifying his demands, Tabin alleged that the district administration did not follow the requirements laid down in the Land Acquisition Act while issuing the eviction order, and circumvented them under the guise of public purpose while overlooking the interest of landowners.
He continued that even the firm executing the four-lane highway has not placed any request to the district administration for additional space for the project and no prior information was also served to owners about the eviction.
The association threatened to launch a democratic stir if their demands are not heeded within the stipulated time.

DA begins demolition drive 

ITANAGAR, Oct 24: As per the decision taken by the Cabinet on October 8, the District Administration Capital Complex started with the demolition drive today to ensure 15 mtrs RoW on both sides of the Highway and also to verify that the compensated structure have been completely demolished.
The eviction drive is being conducted as per procedure and in the most transparent manner and shall continue till Pappu Nallah, a release from the District Administration said. Simultaneously DA, ICC and PWD Highways have ensured that carpeting work begins immediately and the road work gets expedited to avoid inconvenience to commuters.
It is hoped that very soon with efforts of DA, ICC and PWD Highways and the citizens of Capital, the city will have a good 4 lane road as per approved DPR
