PASIGHAT, Sep 26: The Gauhati High Court’s Itanagar permanent bench,
last week directed the Arunachal Pradesh SSA Rajya Mission to release pending salaries of ten employees, engaged in various capacities like Office Assistant/Clerical Staff/DEO/ Peon etc. posted in East Siang District SSA Mission. The HC order came after a writ petition filed by one Oni Tabing (DEO) and nine others.
It may be noted that the petitioners were not getting their salaries since last 27 months. Several representations were submitted in this regard but yielded no positive result.
The HC noted that there is no dispute to the fact that all the petitioners are serving and discharging their duties in theirrespective posts and this fact is also not denied by the counsel representing the State. “This is well settled in law that a person who is rendering service and the employer is utilizing his service, there cannot be any question for withholdingsalary/remuneration due to him. This state-of-affairs cannot be
allowed to continue and the State respondents are legally bound to pay
remuneration to the petitioners”, added the court in its order vide No.
WP(C) 75(AP)/2018, Dtd. 18-07-2018. The HC directed the State
respondents to take immediate steps to release the salary arrears of
all the petitioners within October 18.
It is nearly three months since the order was issued, however the government is yet to act upon it.
